MyCRM – Terms of Service

These Terms of Use (“Terms”) govern your access to and use of the MyCRM platform, including all related services, software, applications, APIs, and websites (collectively, the “Services”), operated by MyCRM (“MyCRM,” “we,” “us,” or “our”).
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you may not use the Services.
1. Eligibility and Account Registration
You must be at least 18 years old and have the authority to enter into a binding agreement to use the Services.
You are responsible for:

Maintaining the confidentiality of your account credentials

All activity that occurs under your account

Ensuring information you provide is accurate and up to date
You may not share or resell access to the Services unless expressly permitted by MyCRM.
2. Description of Services
MyCRM provides a cloud-based customer relationship management and operations platform that may include, depending on your subscription plan:

API access and integrations

AI-assisted features and analytics

Data storage and reporting

Integrations with third-party platforms such as SavorStation and FonaBot
Features and limits vary by plan and may change over time.
3. Subscription Plans, Billing, and Payments
3.1 Subscriptions
Access to the Services is provided on a subscription basis. Subscriptions are billed in advance on a recurring basis (monthly unless otherwise stated).
3.2 Payments
Payments are processed through third-party payment processors (e.g., Stripe). By subscribing, you authorize us to charge your selected payment method.
All fees are non-refundable except where required by law.
3.3 Taxes
You are responsible for all applicable taxes, duties, or government assessments associated with your subscription, unless otherwise stated.
3.4 Failed Payments
If payment fails:

Access to the Services may be limited or suspended

Certain features may become read-only

Continued non-payment may result in termination
4. Free Trials (If Offered)
If a free trial is offered:

It is limited to the stated duration

One trial per business/entity unless otherwise approved

5. Acceptable Use
You agree not to:

Use the Services for unlawful, fraudulent, or abusive purposes

Interfere with or disrupt the Services or infrastructure

Attempt to gain unauthorized access to systems or data

Upload malware, malicious code, or harmful content

Violate applicable laws, regulations, or third-party rights
We reserve the right to suspend or terminate accounts that violate these Terms.
6. Data and Content
6.1 Your Data
You retain ownership of all data you submit to MyCRM (“Customer Data”).
You grant MyCRM a limited license to host, process, and display Customer Data solely to provide the Services.
6.2 Data Responsibility
You are responsible for:

The accuracy and legality of Customer Data

Obtaining required consents

Compliance with privacy and data protection laws
6.3 Data Retention
Upon termination:

Data may be retained for a limited period

We may delete data after that period unless legally required to retain it
7. Third-Party Services
The Services may integrate with third-party platforms (e.g., payment providers, telephony services, AI providers).
MyCRM is not responsible for:

Third-party services, availability, or performance

Data handling practices of third parties

Fees or terms imposed by third parties
Your use of third-party services is governed by their respective terms.
8. Intellectual Property
All intellectual property related to the Services, including software, trademarks, logos, and documentation, is owned by MyCRM or its licensors.
You may not:

Copy, modify, or reverse engineer the Services

Remove proprietary notices

Use MyCRM branding without permission
9. Service Availability and Modifications
We strive to provide reliable service but do not guarantee uninterrupted availability.
We may:

Modify or discontinue features

Perform maintenance or upgrades

Update the Services at any time
10. Termination
You may cancel your subscription at any time through your account or billing portal.
We may suspend or terminate access:

For non-payment

Upon termination, your right to use the Services ceases immediately.
11. Disclaimers
The Services are provided “as is” and “as available.”
To the maximum extent permitted by law, MyCRM disclaims all warranties, including:

Merchantability

Fitness for a particular purpose

Non-infringement
We do not guarantee specific results from use of the Services.
12. Limitation of Liability
To the maximum extent permitted by law:

MyCRM shall not be liable for indirect, incidental, special, or consequential damages

Total liability shall not exceed the amount paid by you to MyCRM in the preceding 12 months
13. Indemnification
You agree to indemnify and hold harmless MyCRM from claims arising out of:

Your use of the Services

Your violation of these Terms

Your Customer Data

Your violation of applicable laws
14. Governing Law
These Terms are governed by the laws of the State of Illinois, without regard to conflict of law principles.
Any disputes shall be resolved in the state or federal courts located in Illinois.
15. Changes to These Terms
We may update these Terms from time to time. Updated Terms will be posted with a revised “Last Updated” date.
Continued use of the Services constitutes acceptance of the updated Terms.
